Don't pin all your hopes on one spot.

This is how you overcome the question above. If you pick four or five good spots, you won't be upset when you get to "your spot" and find that some has beat you to it. Just move on to one of your other pre picked spots.

Find the escape routes.

If you can find the routes that deer are using to move from one area to the other, you can position yourself so that other hunters end driving deer right past you.

Keep away from the fields.

Most hunters in Wmas like to set up near the open fields. You can use this to your advantage, if you prefer to stay away from the crowds.

Stay in your tree stand later.

Wait out other hunters by staying in your tree stand longer. All those hunters going back to their trucks will generate more deer movement, and when those deer come by your stand, you'll be ready for them.

Use the best strategies & techniques.

Even good hunters can all the time learn a few more tricks to add to their arsenal. Don't be afraid to keep learning. The more you learn, the higher the likelihood you'll find success.

Attorney - asset administration Fees Explained

Hello everybody. Now, I discovered Attorney - asset administration Fees Explained. Which could be very helpful in my opinion therefore you.

When you hire a property management enterprise to serve as the liaison between yourself and your tenants, you want to be sure you're getting the best possible property management services for the money. The services a property management enterprise provides can range from ala carte to an all-in-one inclusive package. Along with that comes an array of fees for each. There is no set in stone fee structure we can supply you. But we can educate you on what coarse fees to expect and what each is generally for. In the end it will be up to you to correlate enterprise fee structures and pick the best one that fits within your budget. Below are some of the most coarse fees and what assistance they provide.

What I said. It is not the conclusion that the real about Attorney. You look at this article for info on anyone wish to know is Attorney.

Attorney

Commission

This is an ongoing monthly fee charged to the owner to compensate the property manager for the responsibilities of overseeing the management of their property. This fee can vary from as minute as 3% to over 15% of the monthly gross rent. In place of a ration some managers may payment a flat monthly amount which again can vary from to over 0 per month. All property management fellowships generally payment this fee.

Lease-Up or Setup Fee

This fee is charged to the owner to compensate the property manager for their first time invested and resources used in setting up an owners account; showing property and/or other activities resulting in tenant placement. I guess you could look at it as a "finders fee" for placing a tenant in your property. Once a tenant has been located and first rent income comes in, the property manager will deduct this fee from the rent proceeds. Some property managers have been known to want this fee upfront prior to tenant procurement. Regularly this fee is non-refundable once the property manager has started the process of tenant procurement or any legwork has been initiated with the property. This fee can vary from none to as much as the first months rent, and Regularly is a one-time fee per tenant.

Lease renewal Fee

This fee is charged to the owner when a property manager renews a current tenants lease and covers the costs of initiating paperwork or communication complicated in implementing the new lease document. A property manager may also elucidate this fee if they accomplish a year end inspection of property. This fee can vary from none to 0 or higher, and may be charged every time a lease renewal is implemented.

Advertising Costs

Depending upon the property management company's contract, either they will pay the advertising costs or the owner or they could split the costs. If the manager is willing to cover this cost, most likely they will payment the lease-up or setup fee as outline above. If the management enterprise covers this cost make sure to find out what type advertising or marketing of your property is included. If it's placing your listing on their own web site and other free online classified sites you may not be getting your monies worth. They are many good rental or tenant reserved supply online web sites that bring in distinguished tenants for a uncostly fee and you will want to think these. And don't forget about print media, yard signs, listing on the Mls or even an open house. Nothing is worst than having your property vacant, bringing in no money only because you or your property manager skimped on advertising.

Maintenance Mark-up Charges

This is one of those costs you may never unmistakably of known about or had it disclosed to you. A "Mark-up" is a payment over and beyond the final bill on maintenance and/or fix work done to your property initiated by your property management enterprise when using their vendors or in-house maintenance staff. This should be disclosed in your Manager/Owner compact which Regularly will state the markup as a ration above the final invoice from vendor. For example, your manager had to call a plumber to replace the dishwasher in your rental property. Total charges for completing the job: 0. If your property manager compact states you will incur a 10% markup on all maintenance work the actual cost to you will be 0. Just one of those things to be aware of as these all eat into your profits.

Early Cancellation Fee

The dreaded "3 months and no tenant". Your property manager insist he or she's doing all they can to find you a tenant. But here it is 3 months and still no tenant; what do you do. Well, look at your Manager/Owner compact and that might be your choosing factor. I am not a fan of this fee, and believe it to be an unnecessary fee and for you manager out there this could be the deal breaker. I'll tell you why; if a property manager is doing their due diligence and retention the owners in the loop as far as decision making, market conditions and communication lines open an owner will not be second guessing his property managers abilities. The odds of this scenario happening is unlikely but you must be prepared for it. A cancellation fee can range from none to over 0. To be fair, some managers unmistakably deserve this fee especially if they have pocketed advertising costs, incurred lots of legwork and time invested in your property.

"You've Got To Be Kidding Me" Fees - These are ones I have personally had the satisfaction of running into.
Your property is vacant, but we still will payment our monthly commission or a small flat fee. "A For-Rent Yard Sign Fee". I believe this was /mo. "Preventive Maintenance Fee". This was to cover the "just in case" and changing out A/C filters. If "just in case" never happens they still pocket the money. I believe this was /mo and I still was charged for filters.
In overview

Read your Manager/Owner contract, understand what you are signing, ask lots of questions and know what the fees will buy you in services. A good real estate lawyer can help in negotiating the terms in a compact that suit both parties. These contracts are not set in stone. If your property manager will not negotiate, there are other property management fellowships that are eager to earn your business.

Accident - crisis and Cell Phone Driving Statistics in the United States

Good afternoon. Yesterday, I found out about Accident - crisis and Cell Phone Driving Statistics in the United States. Which is very helpful to me and also you.

Humans straight through evolution should continue to sustain construction great breeds as "Survival of the Fittest," sound that the weaker counterparts will have fewer chances of reproductions. Any way such theory remains argumentative since a diverse breed of humans makes the world go round. Take for example if all humans are similar in likeness just like you and me, then we will have no talented musicians, no great authors, no attractive engineers or doctors assuming that we are none of the above. The world will of course be a boring place to live in. Then there are some citizen who are born to take bold decision while others are risk averse. Some are naturally good at multi-tasking especially the fairer gender yet others are only able to do things one at a time. We may try to keep our survival rate high by holding ourselves out of danger but we are enduringly taking on risk and at the same time cannot avoid others from endangering our lives. Take for example cell phone driving or attempting cell phone text messaging while driving. We could accomplish such functions and belief accidents could never happen to us since we have done it countless of times.

What I said. It is not in conclusion that the real about Accident. You check out this article for info on anyone need to know is Accident.

Accident

The findings by Virginia Tech Driving institute on July 29, 2009 show that statistics accidents by cars and trucks users, distraction caused by dialing cell phone increases the risk of crisis driving incidents by 2.8 times. Distraction caused by cell phone text messaging while driving increases the risk of accidents driving incidents by 23.2 times in comparison to general driving conditions.

According to the Governors Highway security relationship (Ghsa), as of September 2009, a total of 18 states together with District of Columbia have effectively banned all drivers from cell phone text messaging while driving. However, many citizen are still doing it, taking their chances against the law while endangering themselves and the lives of other road users and pedestrians.

For example, the new regulation under the California department of Motor car comes into ensue on January 1, 2009 against cell phone text messaging while driving. Similarly, prohibition for using cell phone while driving was effectively in place since July 1st 2009. The California law also denies teens under the age of 18 with valid driving license from using hands-free devices while driving. Whereas, a total ban is enforced for all age group from performing cell phone text messages while driving. Yet, we still find a lot of drivers continue text messaging since they can keep the cell phone out of sight and away from the window. Some drivers will effort to accomplish a quick cell phone text messaging while writing materials waiting for traffic light to turn green. The total ban on teenagers under the age of 18 with valid license means they will try to evade the laws by text messaging since they are not allowed to use hand-free while driving. To added complicate the issue, enforcing total ban on cell phone text messaging also mean drivers will always be on the look out for enforcement straight through their rear mirror while text messaging, which comes back to the very cause of accidents.

The main hypothesize for total ban on cell phone text messaging while driving is because drivers will have to enduringly take their eyes off the road. Therefore, even if adult age 18 years and above have the liberty of manufacture hands free calls they will still have to keep their eyes off the road when dialing. Headsets and Bluetooth can only minimize our eyes off the road unless every driver start using voice activated automatic dialing. Realistically, its takes a while searching straight through ones cell phone directories to send a text message. Will this ask for the laws to be enforced on all cellular phone manufacturer that every cell phones must have voice assisted dialing functions! For particular drivers under the age of 18, the hypothesize for chatting with their friend on cell phone is to keep then awake while driving. Disallowing hands-free for this age group of course increase the risk of accidents for such drivers. Of course, they are suppose to refrain from driving if they feel tired but not all teenagers abide by the books while some rebellious teenagers take it as challenge against the authority while others are plain ignorant of the laws in place. Maybe the current laws provided regulations aim to keep cell phone driving or cell phone text messaging accidents to a minimal but this does not fully eliminate risk of highway accidents while driving and using cell phone.

We may be quick in adapting to text messaging or talking on the cell with one hand holding it to the ear but there are numerous risk that does not fall into any regulatory category such as checking on your teeth with the rear view mirror while driving or adjusting your hair and operating car radio to quote a few example.

For whatever reasons we need to make calls or text messaging, there are many more reasons that can cause highway accidents while driving. For example holding unrestrained pets in the car which I will discuss in someone else article, slowing down and holding your eyes on just happen accident, driving under the affect of drugs or alcohol, avoiding road animals, driving beyond speed limit and irresponsible driving to name a few.

I hope you have new knowledge about Accident. Where you possibly can offer use within your life. And most of all, your reaction is passed about Accident. Read more.. crisis and Cell Phone Driving Statistics in the United States.

Accident Attorney Nyc - The Steps of a Civil Lawsuit

Hello everybody. Today, I learned all about Accident Attorney Nyc - The Steps of a Civil Lawsuit. Which is very helpful to me therefore you.

While there is no way to predict exactly low long a civil lawsuit will take to go from starting to end, there are a estimate of steps that one can generally expect to go through. These steps must be met in order for the next step to occur.

What I said. It is not the conclusion that the real about Accident Attorney Nyc. You read this article for information about anyone want to know is Accident Attorney Nyc.

Accident Attorney Nyc

The first step of any lawsuit is "pre-filing." This is the stage that occurs before any complaints or claims are filed in any court. Typically, a person's first meeting with his or her attorney occurs while this time. This is the meeting where the attorney will learn exactly what happened in the emergency or incident. Following the preliminary meeting, the attorney or man in his or her office will do some basic explore to frame out where the law in the state stands. This will help the attorney decide if his or her prospective client has a claim worth pursuing.

Once the "pre-filing" facts has been gathered, a complaint will be written and filed with a court. This stage is known as "pleading." In this stage, the plaintiff files his or her complaint and then the named defendant files an answer. Here, the defendant can file a appeal to dismiss the case and any other pleadings are attached.

After all pleadings have been entered, the attorneys for both sides will come up with a discovery plan and time line. This facts is then presented to the judge for approval. This will consist of collecting depositions from individuals as well as conference affidavits and lining up expert witnesses. while this stage, the plaintiff, if suiting for injuries, could be asked to undergo an test by the opposing side to decide the extent of injuries. Once all of the evidence has been collected, one party might decide that things point in their favor so much that a appeal for summary judgment should be filed.

A appeal for summary judgment allows a judge to look at all of the evidence and decide if a inexpensive jury, if seeing at the evidence in the light most favorable to the non-moving party, could still find for the man that moved for summary judgment. If the jury can't or there is a opportunity that the jury could possibly find for the non-moving party, the appeal will not be granted. If there is no possible way for the non-moving party to win, the judge will most likely grant the appeal for summary judgment and the lawsuit is over.

If the lawsuit survives past summary judgment and discovery, the parties will go to trial. while this stage, the jury will hear the evidence presented by both sides and make a factual decision. Once the facts have been decided, the judge will rule in terms of law.

Once the decisions have been answered, the parties may, of course, appeal if they have grounds for an appeal. This whole process could take a very long time.

Attorney - exercise Your ownership With a Traffic Violations Attorney

Hi friends. Yesterday, I learned about Attorney - exercise Your ownership With a Traffic Violations Attorney. Which is very helpful in my opinion and you.

The consequences for traffic violations can vary by state. While some states will allow the extraction of violations from the driver's record, other states might wish that even minor violations stay on description forever. Furthermore, many states allow for a license suspension for multiple violations over a exact duration of time. A traffic violations attorney can help fight these charges and keep the drivers' description clean.

What I said. It isn't the conclusion that the true about Attorney. You check this out article for information on that want to know is Attorney.

Attorney

Although the label for a traffic violation can be costly, it unquestionably is more affordable than the hassle of taking time off from work to go to court and fight the ticket. In fact, many jurisdictions allow the driver to expunge the violation from their description upon completing a defensive driving course. However, paying the fine is an admission of guilt, and there is no guarantee that the driver qualifies for a description expungement. This is especially true for the more serious violations, or for drivers who have more than one violation on their record. Some jurisdictions use a point theory to issuing driving privileges; points are whether added or deducted, based on the seriousness of the offense. Therefore, paying for the label and admitting guilt can lead to a suspension of driving privileges. A traffic violations attorney can help their client fight these charges by whether taking the case to trial for a dismissal, or accepting a plea for lesser charges.

While holding one's driving privileges is the best theorize to get a traffic violations attorney, insurance premiums can rise with multiple violations. insurance providers base their premiums on separate aspects including the drivers age, make and model of the vehicle, and wide driving record. The driver's description is the biggest factor because violations such as speeding or running a red light can be indicators of dangerous driving that could supervene in an crisis or injury. Although one label might not cause a dramatic growth in the insurance premium, multiple violations or even more serious violations, such as driving under the influence or reckless driving can make the cost of insurance unaffordable. Moreover, description of traffic violations may supervene in higher insurance premiums.

Driving is a privilege, not a right. So when many drivers face a suspension of their driving privileges, a traffic violations attorney can help their client profess the freedom of the open road. Even still, many drivers understand the benefit of a clean driving record, which can help save costs with low insurance premiums.

While lawyers in every state cope some cases on a contingency basis, this narrative specifically provides an overview of cases Illinois attorneys can cope on the basis of they only get paid if they win.

What I said. It shouldn't be the conclusion that the actual about Attorney. You read this article for home elevators what you want to know is Attorney.

Attorney

In Illinois, contingency fee cases are most commonly found in injury cases like workers compensation, personal injury, medical malpractice and nursing home abuse. There are occasionally small fees to acquire medical records in a malpractice case. Other cases include legal malpractice and class actions. Illinois legal malpractice cases attorneys will want to see financial damages as a ensue of an attorney's unprofessional guide that would make it financially worthwhile. For example, if a separation attorney's misconduct resulted in less than desirable visitation, a lawyer will probably not take the case on a contingency basis. However, if as a ensue of a separation lawyer's unprofessional guide the client losses 0,000 from the ex's pension, a legal malpractice attorney may take the case on a contingency basis. In class action cases, attorneys work on a contingency basis because so many habitancy have been wronged that if the lawyer wins the damages awarded will be mountainous to compensate all of the clients. The attorney will take a division of the damages awarded to compensate for the work.

Other cases that are sometimes, but now always done on a contingency basis include challenges to a will, commercial litigation, overtime or recompense cases from employment law, collections (if the whole owed is enough) and some child sustain cases. When challenging a will in Illinois, a lawyer can work on a contingency if there is a real dispute. Illinois law prevents them from taking a division of what is recovered if it is just normal representation of an estate. In employment law and overtime cases, lawyers will work on a contingency basis if the dollar amounts owed are large enough. For example, if a client is missing one paycheck a lawyer will probably not take the case on a contingency basis. In child sustain cases, it is rare to find a lawyer to work on a contingency unless there is money that can be collected.

Lawyers are prohibited from handling a separation or criminal case on a contingency basis in Illinois. Illinois attorneys also do not cope defense of civil lawsuits on a contingency basis because there would be no way to get paid.

The fees that an Illinois lawyer charges for a contingency case depends on the type of case and risk involved. In workers' recompense claims for Illinois, the law limits the fee to 20% of any settlement. In medical malpractice cases there is a fee program that changes depending on how much is recovered. In most other matters, it is traditional for the lawyer to recover 1/3 of the money awarded. In some cases this fee will go as high as 40% or more, especially if there is a trial and/or appeal.

It might have been difficult a few years ago but not anymore. Let me show you how to find man in prison and get loads of background data about them at the same time.

Step 1: Use the Bop Federal Inmate Lookup

The Federal Bureau of Prisons (Bop) provides a website at bop.gov. On the site you will find the Bop federal inmate locater which is a searchable database of all federal inmates since 1982.

Type in the details of the man that you're finding for and click the button to see a list of names together with the prisons where they're being held. When I did this recently the site gave me a long list of inmates because of the coarse name that I was searching for so I had to find out which one, if any, of the inmates was the man that I was finding for.

Step 2: Get more background data on someone

You may find like I did, that when you've narrowed down your crusade by race, age and sex you're still left with more than one name and you can't be sure that any one of them is the one you're finding for. You need to get more data on this person.

The Bop site is ok, it's free and it might just tell you all you need to know. If it doesn't then you should subscribe to a web site that will give you all the data you could ever wish for on prison inmates and anyone else you fancy finding up. These websites get data from thousands of places all over the Internet and offline too. Car urgency - Do You Need a Lawyer?

Car urgency - Do You Need a Lawyer?

Attorney - Car urgency - Do You Need a Lawyer?

Good evening. Now, I discovered Attorney - Car urgency - Do You Need a Lawyer?. Which is very helpful if you ask me so you.

The need for a lawyer in a car accident typically depends on the circumstances surrounding the event. However, in view of a extremely litigious environment, it is important to look at the degree of the car accident and judge accordingly. A simple fender-bender can be settled straight through your insurer but an accident consuming corporeal harm or injury may require a lawyer. If no one is hurt, then one can normally do without the services of a lawyer.

What I said. It is not the actual final outcome that the true about Attorney. You look at this article for information on anyone need to know is Attorney.

Attorney

The need for a lawyer will thus arise if one has suffered some kind of permanent injury as a ensue of the car accident causing loss of time away from work, school or household chores. In such an event you may want to consult a lawyer for representation in a claim against the man responsible for such injuries.

An attorney or a lawyer that deals with personal injury is who you need to touch for getting your case resolved. There are some cases that need the immediate attentiveness of a lawyer such as:

Serious injuries resulting in broken bones, permanent injuries and hospitalization. The ensue of the car accident is death. When there are other parties involved like pedestrians and other vehicles. The quiz, of who is at fault has not been adequately answered. Inaccuracies in the police report manufacture you the party at fault. Involving technical, medical and legal issues. Insurance matters like low limit on liability insurance, having no insurance, not having paid guarnatee premiums and problems with the insurer himself.

In some other cases, an attorney can be helpful but not important are:

Seeking advice on settling a claim, handling negotiations with an insurer Requiring clarifications on terms of course and confused on what possession you may or may not have Seeking expert advice for paperwork Determining if insurer is acting in bad faith. When fault is an issue.

If there is an guarnatee claim process, it might necessitate the hiring of a car accident lawyer. Typically, lawyers in their advertisements will urge you to touch a car accident attorney so as not to lose your right to sue at a later date. They however, hardly ever specify the circumstances under which you would be required to do the needful. So then, how does one determine whether or not the advice of a car accident attorney is necessary.

Usually, the clear-cut claims do not require much advice or consultation from a car accident attorney. This would be in cases where the liability has been clearly defined and the man has admitted his fault, wherein injuries are only minor and medical and other expenses are negligible. It would also be applicable if there are no extenuating circumstances requiring investigation such as uncertainties about guarnatee coverage, questions about statute of limitations, previously existing injuries to the same body parts and involved accident scenario. Most people do not know of these problems when they happen and prefer to deal with their claims on their own and only later perceive the need for a lawyer to clear out the mess.

The car accident lawyer will help when you are uncertain as to who is liable, how to deal with your claim or even when you are unsure of negotiating your own settlement. Similarly, if the adjuster asks you to supply medical records prior to the accident, or makes you an offer that is not in consonance with your claim or even offers to pay you in parts rather than a lump sum, you may need to consult a lawyer for additional clarifications.

It is any way imperative that you consult a car accident lawyer when:

The guarnatee company denies your claim You are seriously injured with huge medical bills or have only residual disability The injured man is a minor Your claim is important but proof of loss is intangible Liability is in question Complicated facts and circumstances surrounding your accident The injured party has slapped you with a lawsuit.

Good afternoon. Now, I discovered Attorney - Hospice Fraud - A recapitulate For Employees, Whistleblowers, Attorneys, Lawyers and Law Firms. Which may be very helpful to me so you.

Hospice fraud in South Carolina and the United States is an expanding question as the estimate of hospice patients has exploded over the past few years. From 2004 to 2008, the estimate of patients receiving hospice care in the United States grew roughly 40% to nearly 1.5 million, and of the 2.5 million habitancy who died in 2008, nearly one million were hospice patients. The marvelous majority of habitancy receiving hospice care receive federal benefits from the federal government through the Medicare or Medicaid programs. The health care providers who provide hospice services traditionally enroll in the Medicare and Medicaid programs in order to qualify to receive payments under these government programs for services rendered to Medicare and Medicaid eligible patients.

What I said. It is not the final outcome that the true about Attorney. You see this article for information about an individual want to know is Attorney.

While most hospice health care organizations provide suitable and ethical rehabilitation for their hospice patients, because hospice eligibility under Medicare and Medicaid involves clinical judgments which may corollary in the payments of large sums of money from the federal government, there are enormous opportunities for fraudulent practices and false billing claims by unscrupulous hospice care providers. As up-to-date federal hospice fraud enforcement actions have demonstrated, the estimate of health care clubs and individuals who are willing to try to defraud the Medicare and Medicaid hospice benefits programs is on the rise.

A up-to-date example of hospice fraud interesting a South Carolina hospice is Southern Care, Inc., a hospice firm that in 2009 paid .7 million to resolve an Fca case. The defendant operated hospices in 14 other states, too, including Alabama, Georgia, Indiana, Iowa, Kansas, Louisiana, Michigan, Mississippi, Missouri, Ohio, Pennsylvania, Texas, Virginia and Wisconsin. The alleged frauds were that patients were not eligible for hospice, to wit, were not terminally ill, lack of documentation of concluding illnesses, and that the firm marketed to inherent patients with the promise of free medications, supplies, and the provision of home health aides. Southern Care also entered into a 5-year Corporate Integrity agreement with the Oig as part of the settlement. The qui tam relators received roughly million.

Understanding the Consequences of Hospice Fraud and Whistleblower Actions

U.S. And South Carolina consumers, including hospice patients and their family members, and health care employees who are employed in the hospice industry, as well as their Sc lawyers and attorneys, should clue themselves with the basics of the hospice care industry, hospice eligibility under the Medicare and Medicaid programs, and hospice fraud schemes that have advanced across the country. Consumers need to safe themselves from unethical hospice providers, and hospice employees need to guard against knowingly or unwittingly participating in health care fraud against the federal government because they may subject themselves to administrative sanctions, including lengthy exclusions from working in an club which receives federal funds, enormous civil monetary penalties and fines, and criminal sanctions, including incarceration. When a hospice worker discovers fraudulent escort interesting Medicare or Medicaid billings or claims, the worker should not share in such behavior, and it is imperative that the unlawful escort be reported to law enforcement and/or regulatory authorities. Not only does reporting such fraudulent Medicare or Medicaid practices shield the hospice worker from exposure to the foregoing administrative, civil and criminal sanctions, but hospice fraud whistleblowers may benefit financially under the reward provisions of the federal False Claims Act, 31 U.S.C. §§ 3729-3732, by bringing false claims suits, also known as qui tam or whistleblower suits, against their employers on profit of the United States.

Types of Hospice Care Services

Hospice care is a type of health care service for patients who are terminally ill. Hospices also provide withhold services for the families of terminally ill patients. This care includes physical care and counseling. Hospice care is normally provided by a group group or hidden firm stylish by Medicare and Medicaid. Hospice care is available for all age groups, including children, adults, and the elderly who are in the final stages of life. The purpose of hospice is to provide care for the terminally ill sick person and his or her family and not to cure the concluding illness.

If a sick person qualifies for hospice care, the sick person can receive healing and withhold services, including nursing care, healing group services, doctor services, counseling, homemaker services, and other types of services. The hospice sick person will have a team of doctors, nurses, home health aides, group workers, counselors and trained volunteers to help the sick person and his or her family members cope with the symptoms and consequences of the concluding illness. While many hospice patients and their families can receive hospice care in the relax of their home, if the hospice patient's health deteriorates, the sick person can be transferred to a hospice facility, hospital, or nursing home to receive hospice care.

Hospice Care Statistics

The estimate of days that a sick person receives hospice care is often referenced as the "length of stay" or "length of service." The length of service is dependent on a estimate of dissimilar factors, including but not puny to, the type and stage of the disease, the capability of and way to health care providers before the hospice referral, and the timing of the hospice referral. In 2008, the midpoint length of stay for hospice patients was about 21 days, the midpoint length of stay was about 69 days, roughly 35% of hospice patients died or were discharged within 7 days of the hospice referral, and only about 12% of hospice patients survived longer than 180 days.

Most hospice care patients receive hospice care in hidden homes (40%). Other locations where hospice services are provided are nursing homes (22%), residential facilities (6%), hospice sick person facilities (21%), and acute care hospitals (10%). Hospice patients are commonly the elderly, and hospice age group percentages are 34 years or less (1%), 35 - 64 years (16%), 65 - 74 years (16%), 75 - 84 years (29%), and over 85 years (38%). As for the concluding illness resulting in a hospice referral, cancer is the prognosis for roughly 40% of hospice patients, followed by debility unspecified (15%), heart disease (12%), dementia (11%), lung disease (8%), stroke (4%) and kidney disease (3%). Medicare pays the great majority of hospice care expenses (84%), followed by hidden guarnatee (8%), Medicaid (5%), charity care (1%) and self pay (1%).

As of 2008, there were roughly 4,700 locations which were providing hospice care in the United States, which represented about a 50% growth over ten years. There were about 3,700 clubs and organizations which were providing hospice services in the United States. About half of the hospice care providers in the United States are for-profit organizations, and about half are non-profit organizations.
General summary of the Medicare and Medicaid Programs

In 1965, Congress established the Medicare agenda to provide health guarnatee for the elderly and disabled. Payments from the Medicare agenda arise from the Medicare Trust fund, which is funded by government contributions and through payroll deductions from American workers. The Centers for Medicare and Medicaid Services (Cms), previously known as the health Care Financing administration (Hcfa), is the federal group within the United States group of health and Human Services (Hhs) that administers the Medicare agenda and works in partnership with state governments to administer Medicaid.

In 2007, Cms reorganized its ten geography-based field offices to a Consortia structure based on the agency's key lines of business: Medicare health plans, Medicare financial management, Medicare fee for service operations, Medicaid and children's health, study & certification and capability improvement. The Cms consortia consist of the following:

• Consortium for Medicare health Plans Operations
• Consortium for Financial administration and Fee for service Operations
• Consortium for Medicaid and Children's health Operations
• Consortium for capability revising and study & Certification Operations

Each consortium is led by a Consortium Administrator (Ca) who serves as the Cms's national focal point in the field for their firm line. Each Ca is responsible for consistent implementation of Cms programs, policy and guidance across all ten regions for matters pertaining to their firm line. In expanding to accountability for a firm line, each Ca also serves as the Agency's senior administration legal for two or three Regional Offices (Ros), representing the Cms Administrator in external matters and overseeing administrative operations.

Much of the daily administration and doing of the Medicare agenda is managed through hidden guarnatee clubs that contract with the Government. These hidden guarnatee companies, sometimes called "Medicare Carriers" or "Fiscal Intermediaries," are charged with and responsible for accepting Medicare claims, determining coverage, and manufacture payments from the Medicare Trust Fund. These carriers, including Palmetto Government Benefits Administrators (hereinafter "Pgba"), a group of Blue Cross and Blue Shield of South Carolina, control pursuant to 42 U.S.C. §§ 1395h and 1395u and rely on the good faith and careful representations of health care providers when processing claims.

Over the past forty years, the Medicare agenda has enabled the elderly and disabled to regain indispensable healing services from healing providers throughout the United States. indispensable to the success of the Medicare agenda is the underlying view that health care providers accurately and as a matter of fact submit claims and bills to the Medicare Trust Fund only for those healing treatments or services that are legitimate, inexpensive and medically necessary, in full compliancy with all laws, regulations, rules, and conditions of participation, and, further, that healing providers not take benefit of their elderly and disabled patients.

The Medicaid agenda is available only to definite low-income individuals and families who must meet eligibility requirements set forth by federal and state law. Each state sets its own guidelines concerning eligibility and services. Although administered by individual states, the Medicaid agenda is funded primarily by the federal government. Medicaid does not pay money to patients; rather, it sends payments directly to the patient's health care providers. Like Medicare, the Medicaid agenda depends on health care providers to accurately and as a matter of fact submit claims and bills to agenda administrators only for those healing treatments or services that are legitimate, inexpensive and medically necessary, in full compliancy with all laws, regulations, rules, and conditions of participation, and, further, that healing providers not take benefit of their indigent patients.

Medicare & Medicaid Hospice Laws Which influence Sc Hospices

Hospice fraud occurs when hospice organizations, by and through their employees, agents and owners, knowingly violate the terms and conditions of the applicable Medicare and Medicaid hospice statutes, regulations, rules and conditions of participation. In order to be able to recognize hospice fraud, hospices, hospice patients, hospice employees and their attorneys and lawyers must know the Medicare laws and requirements relating to hospice care benefits.

Medicare's two main sources of authorization for hospice benefits are found in the group protection Act and the U.S. Code of Federal Regulations. The statutory provisions are primarily found at 42 U.S.C. §§ 1395d, 1395e, 1395f(a)(7), 1395x(d)(d), and 1395y, and the regulatory provisions are found at 42 C.F.R. Part 418.

To be eligible for Medicare benefits for hospice care, the sick person must be eligible for Medicare Part A and be terminally ill. 42 C.F.R. § 418.20. concluding illness is established when "the individual has a healing prognosis that his or her life expectancy is 6 months or less if the illness runs its normal course." 42 C.F.R. § 418.3; 42 U.S.C. § 1395x(d)(d)(3). The patient's doctor and the healing director of the hospice must warrant in writing that the sick person is "terminally ill." 42 U.S.C. § 1395f(a)(7); 42 C.F.R. § 418.20. After a patient's first certification, Medicare provides for two ninety-day benefit periods followed by an unlimited estimate of sixty-day benefit periods. 42 U.S.C. § 1395d(a)(4). At the end of each ninety- or sixty-day period, the sick person can be re-certified only if at that time he or she has less than six months to live if the illness runs its normal course. 42 U.S.C. § 1395f(a)(7)(A). The written certification and re-certifications must be maintained in the patient's healing records. 42 C.F.R. § 418.23. A written plan of care must be established for each sick person setting forth the types of hospice care services the sick person is scheduled to receive, 42 U.S.C. § 1395f(a)(7)(B), and the hospice care has to be provided in accordance with such plan of care. 42 U.S.C. § 1395f(a)(7)(C); 42 C.F.R. § 418.56. Clinical records for each hospice sick person must be maintained by the hospice, including plan of care, assessments, clinical notes, signed consideration of election, sick person responses to medication and therapy, doctor certifications and re-certifications, outcome data, improve directives and doctor orders. 42 C.F.R. § 418.104.

The hospice must regain a written consideration of choice from the sick person to elect to receive Medicare hospice benefits. 42 C.F.R. § 418.24. Importantly, once a sick person has elected to receive hospice care benefits, the sick person waives Medicare benefits for healing rehabilitation for the concluding disease upon which is the admitting diagnosis. 42 C.F.R. § 418.24(d).

The hospice must prescribe an Interdisciplinary Group (Idg) or groups composed of individuals who work together to meet the physical, medical, psychosocial, emotional, and spiritual needs of the hospice patients and families facing concluding illness and bereavement. 42 C.F.R. § 418.56. The Idg members must provide the care and services offered by the hospice, and the group, in its entirety, must supervise the care and services. A registered nurse that is a member of the Idg must be designated to provide coordination of care and to ensure continuous evaluation of each patient's and family's needs and implementation of the interdisciplinary plan of care. The interdisciplinary group must include, but is not puny to, the following great and competent professionals: (i) A doctor of rehabilitation or osteopathy (who is an worker or under contract with the hospice); (ii) A registered nurse; (iii) A group worker; and, (iv) A pastoral or other counselor. 42 C.F.R. § 418.56.

The Medicare hospice regulations, at 42 C.F.R. § 418.200, summarize the requirements for hospice coverage in pertinent part as follows:

To be covered, hospice services must meet the following requirements. They must be inexpensive and indispensable for the palliation and administration of the concluding illness as well as related conditions. The individual must elect hospice care in accordance with §418.24. A plan of care must be established and periodically reviewed by the attending physician, the healing director, and the interdisciplinary group of the hospice agenda as set forth in §418.56. That plan of care must be established before hospice care is provided. The services provided must be consistent with the plan of care. A certification that the individual is terminally ill must be completed as set forth in section §418.22.

The group protection Act, at 42 U.S.C. § 1395y(a), limits Medicare hospice benefits, providing in pertinent part as follows: "Notwithstanding any other provision of this title, no cost may be made under part A or part B for any expenses incurred for items or services-... (C) in the case of hospice care, which are not inexpensive and indispensable for the palliation or administration of concluding illness...." 42 C.F.R. § 418.50 (hospice care must be "reasonable and indispensable for the palliation and administration of concluding illness"). Palliative care is defined in the regulations as "patient and family-centered care that optimizes capability of life by anticipating, preventing, and treating suffering. Palliative care throughout the continuum of illness involves addressing physical, intellectual, emotional, social, and spiritual needs and to facilitate sick person autonomy, way to information, and choice." 42 C.F.R. § 418.3.

Medicare pays hospice agencies a daily rate for each day a beneficiary is enrolled in the hospice benefit and receives hospice care. The daily payments are made regardless of the estimate of services furnished on a given day and are intended to cover costs that the hospice incurs in furnishing services identified in the patient's plan of care. There are four levels of payments which are made based on the estimate of care required to meet beneficiary and family needs. 42 C.F.R. § 418.302; Cms Hospice Fact Sheet, November 2009. These four levels, and the corresponding 2010 daily rates, are as follows: routine home care (2.91); continuous home care (4.10); sick person respite care (7.83); and, normal sick person care (5.74).

The combination annual cap per sick person in 2009 was ,014.50. This cap is thought about by adjusting the traditional hospice sick person cap of ,500, set in 1984, by the consumer Price Index. See Cms Internet-Only manual 100-04, chapter 11, section 80.2; 42 U.S.C. § 1395f(i); 42 C.F.R. § 418.309. The Medicare Claims Processing Manual, at chapter 11 - Processing Hospice Claims, in Section 80.2, entitled "Cap on wide Hospice Reimbursement," provides in pertinent part as follows: "Any payments in excess of the cap must be refunded by the hospice."

Hospice patients are responsible for Medicare co-insurance payments for drugs and respite care, and the hospice may payment the sick person for these co-insurance payments. However, the co-insurance payments for drugs are puny to the lesser of or 5% of the cost of the drugs to the hospice, and the co-insurance payments for respite care are commonly 5% of the cost made by Medicare for such services. 42 C.F.R. § 418.400.

The Medicare and Medicaid programs want institutional health care providers, including hospice organizations, to file an enrollment application in order to qualify to receive the programs' benefits. As part of these enrollment applications, the hospice providers warrant that they will comply with Medicare and Medicaid laws, regulations, and agenda instructions, and additional warrant that they understand that cost of a claim by Medicare and Medicaid is conditioned upon the claim and underlying transaction complying with such agenda laws and requirements. The Medicare Enrollment Application which hospice providers must execute, Form Cms-855A, states in part as follows: "I agree to abide by the Medicare laws, regulations and agenda instructions that apply to this provider. The Medicare laws, regulations, and agenda instructions are available through the Medicare contractor. I understand that cost of a claim by Medicare is conditioned upon the claim and the underlying transaction complying with such laws, regulations, and agenda instructions (including, but not puny to, the Federal Aks and Stark laws), and on the provider's compliancy with all applicable conditions of participation in Medicare."

Hospices are commonly required to bill Medicare on a monthly basis. See the Medicare Claims Processing Manual, at chapter 11 - Processing Hospice Claims, in Section 90 - Frequency of Billing. Hospices commonly file their hospice Medicare claims with their Fiscal Intermediary or Medicare Carrier pursuant to the Cms Claims manual Form Cms 1450 (sometime also called a Form Ub-04 or Form Ub-92), either in paper or electronic form. These claim forms consist of representations and certifications which state in pertinent part that: (1) misrepresentations or falsifications of indispensable data may serve as the basis for civil monetary penalties and criminal convictions; (2) submission of the claim constitutes certification that the billing data is true, definite and complete; (3) the submitter did not knowingly or recklessly disregard or misrepresent or conceal material facts; (4) all required doctor certifications and re-certifications are on file; (5) all required sick person signatures are on file; and, (6) for Medicaid purposes, the submitter understands that because cost and pleasure of this claim will be from Federal and State funds, any false statements, documents, or concealment of a material fact are subject to prosecution under applicable Federal or State Laws.

Hospices must also file with Cms an annual cost and data report of Medicare payments received. 42 U.S.C. § 1395f(i)(3); 42 U.S.C. § 1395x(d)(d)(4). The annual hospice cost and data reports, Form Cms 1984-99, consist of representations and certifications which state in pertinent part that: (1) misrepresentations or falsifications of data contained in the cost report may be punishable by criminal, civil and administrative actions, including fines and/or imprisonment; (2) if any services identified in the report were the product of a direct or indirect kickback or were otherwise illegal, then criminal, civil and administrative actions may result, including fines and/or imprisonment; (3) the report is a true, definite and perfect statement prepared from the books and records of the provider in accordance with applicable instructions, except as noted; and, (4) the signing officer is customary with the laws and regulations concerning the provision of health care services and that the services identified in this cost report were provided in compliancy with such laws and regulations.

Hospice Anti-Fraud enforcement Statutes

There are a estimate of federal criminal, civil and administrative enforcement provisions set forth in the Medicare statutes which are aimed at preventing fraudulent conduct, including hospice fraud, and which help voice agenda integrity and compliance. Some of the more foremost enforcement provisions of the Medicare statutes consist of the following: 42 U.S.C. § 1320a-7b (Criminal fraud and anti-kickback penalties); 42 U.S.C. § 1320a-7a and 42 U.S.C. § 1320a-8 (Civil monetary penalties for fraud); 42 U.S.C. § 1320a-7 (Administrative exclusions from participation in Medicare/Medicaid programs for fraud); 42 U.S.C. § 1320a-4 (Administrative subpoena power for the Comptroller General).

Other criminal enforcement provisions which are used to combat Medicare and Medicaid fraud, including hospice fraud, consist of the following: 18 U.S.C. § 1347 (General health care fraud criminal statute); 21 U.S.C. §§ 353, 333 (Prescription Drug Marketing Act); 18 U.S.C. § 669 (Theft or Embezzlement in association with health Care); 18 U.S.C. § 1035 (False statements relating to health Care); 18 U.S.C. § 2 (Aiding and Abetting); 18 U.S.C. § 3 (Accessory after the Fact); 18 U.S.C. § 4 (Misprision of a Felony); 18 U.S.C. § 286 (Conspiracy to defraud the Government with respect to Claims); 18 U.S.C. § 287 (False, Fictitious or Fraudulent Claims); 18 U.S.C. § 371 (Criminal Conspiracy); 18 U.S.C. § 1001 (False Statements); 18 U.S.C. § 1341 (Mail Fraud); 18 U.S.C. § 1343 (Wire Fraud); 18 U.S.C. § 1956 (Money Laundering); 18 U.S.C. § 1957 (Money Laundering); and, 18 U.S.C. § 1964 (Racketeer Influenced and Corrupt Organizations ("Rico")).

The False Claims Act (Fca)

Hospice fraud whistleblowers may benefit financially under the reward provisions of the federal False Claims Act, 31 U.S.C. §§ 3729-3732, by bringing false claims suits, also known as qui tam or whistleblower suits, against their employers on profit of the United States. The plaintiff in a hospice fraud whistleblower suit is also known as a relator. The most common Fca provisions upon which hospice fraud qui tam or whistleblower relators rely are found in 31 U.S.C. § 3729: (A) knowingly presents, or causes to be presented, a false or fraudulent claim for cost or approval; (B) knowingly makes, uses, or causes to be made or used, a false report or statement material to a false or fraudulent claim; (C) conspires to commit a violation of subparagraph (A), (B), (D), (E), (F), or (G);..., and, (G) knowingly makes, uses, or causes to be made or used, a false report or statement material to an enforcement to pay or forward money or property to the Government, or knowingly conceals or knowingly and improperly avoids or decreases an enforcement to pay or forward money or property to the Government.... There is no requirement to prove exact intent to defraud. Rather, it is only indispensable to prove actual knowledge of the false claims, false statements, or false records, or the defendant's deliberate indifference or reckless disregard of the truth or falsity of the information. 31 U.S.C. § 3729(b).

The Fca anti-retaliation provision protects the hospice whistleblower from retaliation from the hospice when the worker (or a contractor) "is discharged, demoted, suspended, threatened, harassed, or in any other manner discriminated against in the terms and conditions of employment" for taking operation to try to stop the fraudulent activity. 31 U.S.C. § 3730(h). A hospice employee's relief includes reinstatement, 2 times the estimate of back pay, interest on the back pay, and compensation for any special damages sustained as a corollary of the discrimination or retaliation, including litigation costs and inexpensive attorneys' fees.

A Sc hospice fraud Fca whistleblower would initially file a disclosure statement, complaint and supporting documents with the U.S. Attorney's Office in Columbia, South Carolina, and the Us Attorney General. After the disclosures are filed, a federal court complaint can be filed. The Sc group where the frauds occurred, the relator's residence, and the defendant residence, will resolve which group the case will be assigned. There are eleven federal court divisions in South Carolina. Once the case has been filed, the government has 60 days to resolve either or not to intervene. While this time, federal government investigators located in South Carolina will research the claims. If the case complicated Medicaid, Sc Medicaid fraud unit investigators will likely become complicated as well. If the government intervenes in the case, the U.S. Attorney for South Carolina is normally the lead attorney. If the government does not intervene, the relator's Sc attorney will prosecute the case. In South Carolina, expect a qui tam case to take one to two years to get to trial.

Tips on Recognizing Hospice Fraud Schemes

The Hhs Office of Inspector normal (Oig) has issued special Fraud Alerts for fraudulent and abusive practices of hospices. U.S. And South Carolina hospices, patients, hospice employees and whistleblowers, their attorneys and lawyers, should be customary with these hospice fraud practices. Tips on recognizing hospice frauds in South Carolina and the U.S. Are:

• A hospice gift free goods or goods at below store value to induce a nursing home to refer patients to the hospice.
• False representations in a hospice's Medicare/Medicaid enrollment form.
• A hospice paying "room and board" payments to the nursing home in amounts in excess of what the nursing home would have received directly from Medicaid had the sick person not been enrolled in the hospice.
• False statements in a hospice's claim form (Cms Forms 1450, Ub-04 or Ub-92).
• A hospice falsely billing for services that were not inexpensive or indispensable for the palliation of the symptoms of a terminally ill patient.
• A hospice paying amounts to the nursing home for "additional" services that Medicaid thought about included in its room and board cost to the hospice.
• A hospice paying above fair store value for "additional" non-core services which Medicaid does not reconsider to be included in its room and board payments to the nursing home.
• A hospice referring patients to a nursing home to induce the nursing home to refer its patients to the hospice.
•A hospice providing free (or below fair store value) care to nursing home patients, for whom the nursing home is receiving Medicare cost under the skilled nursing facility benefit, with the hope that after the sick person exhausts the skilled nursing facility benefit, the sick person will receive hospice services from that hospice.
• A hospice providing staff at its expense to the nursing home to accomplish duties that otherwise would be performed by the nursing home.
• Incomplete or no written Plan of Care was established or reviewed at exact intervals.
• Plan of Care did not consist of an evaluation of needs.
• Fraudulent statements in a hospice's cost report to the government.
• consideration of choice was not obtained or was fraudulently obtained.
• Rn supervisory visits were not made for home health aide services.
• Certification or Re-certification of concluding illness was not obtained or was fraudulently obtained.
• No Plan of care was included for bereavement services.
• Fraudulent billing for upcoded levels of hospice care.
• Hospice did not escort a self-assessment of capability and care provided.
• Clinical records were not maintained for every patient.
• Interdisciplinary group did not retell and update the plan of care for each patient.

Recent Hospice Fraud enforcement Cases

The Doj and U.S. Attorney's Offices have been active in enforcing hospice fraud cases.

In 2009, Kaiser Foundation Hospitals located an Fca lawsuit by paying .8 million to the federal government. The defendant allegedly failed to regain written certifications of concluding illness for a estimate of its patients.

In 2006, Odyssey Healthcare, a national hospice provider, paid .9 million to resolve a qui tam suit for false claims under the Fca. The hospice fraud allegations were commonly that Odyssey billed Medicare for providing hospice care to patients when they were not terminally ill and ineligible for Medicare hospice benefits. A Corporate Integrity agreement was also a part of the settlement. The hospice fraud qui tam relator received .3 million for blowing the whistle on the defendant.

In 2005, Faith Hospice, Inc., located claims an Fca claim for 0,000. The hospice fraud allegations were commonly that Faith Hospice billed Medicare for providing hospice care to patients more than half of whom were not terminally ill.

In 2005, Home Hospice of North Texas located an Fca claim for 0,000 concerning allegations of fraudulently billing Medicare for ineligible hospice patients.

In 2000, Michigan osteopath Donald Dreyfuss, who pleaded guilty to criminal fraud charges, including violation of the Aks for receiving illegal kickbacks from a hospice for recommending the hospice to the staff of his nursing home, located an Fca suit for million.

Conclusion

Hospice fraud is a growing question in South Carolina and throughout the United States. South Carolina hospice patients, hospice employees, and their Sc lawyers and attorneys, should be customary with the basics of the hospice care industry, hospice eligibility under the Medicare and Medicaid programs, and typical hospice fraud schemes. Hospice organizations should take steps to ensure full compliancy with Medicare/Medicaid hospice billing requirements to avoid hospice fraud allegations and Fca litigation.
